The will
of Maria Cusley
In the name of God Amen the
one and twentieth of May in the year of our Lord God according to the Computations
of
the church of England One thousand six hundred fiftie and eight. I Mary Cusley
daughter to Richard Cusley late of Cottingham in the Countie of Northampton
clarke being weake in bodie but in perfect memorie prayse be given to God do
make and declare this my last will and testament bearing date the sixth day
of
November in the year of our Lord One Thousand six hundred fiftie and seven
give and bequeath to me the aforesaid Mary Cusely all that one messuage and
tenement in Brownesland with all and singular the appurtenances thereunto
belonging or in any wayes aperteining which were heretofore in the tenure or
occupation of Thomas Anderton or Willm Anderton or one of them and by them
sold unto Willm Malbone gentleman and his assignes commonly knowne and
called by the name of Crow neaft which tenement was by the said William
Malbone passed to Richard Malbone for five hundred years and afterwards
was absolutely sold by the said William Malbone to the said Richard Malbone
and his assigns for ever and by
the said Richard Malbone and his trustees
sold unto the said Richard Cusley and his assigns for ever which said
messuage and tenement with all houses edifices buildings orchards
gardens lands meadows pastures feedinges wayes watercourses fishings
woods underwoods commons profits previlidges and hereditaments what-
soever to the said messuage or tenement in any wise belonging or appertaining
was by the said will given and bequeathed unto me the said Mary Cusley my
heirs executors and assignes for ever both the said lease of five hundred
years and alsoe the fee simple for ever and by the said will there was likewise
given unto me by my said father all his plate and all his linnen tablecloathes
napkins cubboard cloathes sheetes pillowbeares and all his bedds and bedding
and bedding cloathes with curtaines and vallance and also twentie poundes
of money And after the payment of his debts and funerall expenses discharged
did by the said will give the remainder of his estate to be equally devided
betweene and my brother Sam Cusley paying to my brother John Cusley
twelve pound for a legacie and of that his will did make me the said Mary
Cusley his sole executrix by vertue and power wherereof I do disposed of
the said estate in manner following And first my will and mind is that all
my part of the debts owing by my said father Richard Cusley to anie
person or persons whatsoever with a debt of thirtie pounds owing to
Richard Willcoxon bee fourth of the said estate reall and personall first
paid and discharged at the discretion of my executors hereafter named
Item I give and bequeath to Mr Thomas Dawtie preacher at Medborne
one gilded silver chair and five pounds in money for preaching my
funerall sermon Item I give and bequeath unto my Ant Anne Borrow
the sume of tenne pounds Item I give and bequeath unto Hannah Borrow
her daughter the sum of five pounds Item I give and bequeath unto my Ant
Elizabeth Haswell the sume of tenne pounds Item I give and bequeath unto
Alice her daughter the sum of five pounds Item I give and
bequeath unto
my Ant Primrose the widdow of Willm Primrose the some of tenn poundes
Item I give and bequeath unto my cozen Frances Wade wife of Zacary Wade
the some of ten poundes Item I give and bequeath unto Mary Marson and Frances
Wade her daughter either of them twentie shillings to buy them ringes Item
I
give and bequeath unto my cozen James _____ and Allice his wife and Hanna
Morgin twentie shillinges a piece to buy them ringes Item I give and bequeath
unto my cozen Frances Willcoxen and Mary Willcoxon my bedde with all the
commorities therein and my truncke of linnine to be equally devided betweene
them
and I give unto the said Mary Willcoxon my _____ Item I give and bequeath unto
my servant maide Alice
Clones the sum of ten pounds and I give her more the
bed and beddinge wheron she lyeth Item I give unto Sarah ____ the sume of
twentie shillinges Item my will and mind is that the legacies above mentioned
my debts and funerall expences and my fathers debts be fully satisified and
discharged
out of my estate reall and personall at the discretion of my Executor and afterward
I
give and bequeath unto my brother Sam Cusely all that messuage and tenement
with all the building thereon and lands therunto belonging with all the
appurtenances thereunto belonging called by Crow Neast aforementioned
to his one sole and proper use for ever he the said Sam paying out of the profitts
thereof the sume of twentie poundes by five poundes a yeare unto John Cusley
my brother which I give and bequeath unto him the said John Cusley as a legacie
allwais provided and nevertheless it is my mind and will that if either said
John Cusely or Sam Cusely or either of them shall at any time or times hereafter
unjustly or rongfully sue arrest implead or trouble in sutes of law or other
wayes
my executor hereafter named his debutie or his executor or administrators or
assigns or any of them for my matter or thing whatsoever which he or they shall
lawfully do in and about the pursuance and performance of the aforementioned
will and testament of the aforesaid Richard Cusley or of this my will and
testament that then and in each case my executor and his assigns or his executor
or administrator may so often as he or they shall bee soe unjustly sued or
impleaded
as aforesaid enter into the said messuage and tenement and all the buildings
and lands thereunto belonging called the Crowneast aforesaid and to have and
to
hold the same for during and until he or they soe unjustly sued or impleaded
as aforesaid shall out of the cleare rent issues and profits thereof perceive
receive and take all such sums or funds of money with all his other cost and
damages whatesoever which he or they shall be occasioned to expend and
suffer in the lawfull plaint and defense of him or themselves against the unjust
suites and other unlawfull proceedings practised against him or them by the
said
John Cusley or Sam.Cusley or any other person or persons acting by from or
under them or either of them and from and after my said executor or his
assignes or his executors or administrator or such of them as shall bee so
___
shall have had and received out of the lands or profitts aforesaid there full
costes and damages as aforesaid that then he or they shall deliver upp the
lands messuage and tenement lands and premises as aforesaid unto the said
Sam.Cusley to posses and enjoy the same as in his former estate And lastly
I
the said Mary Cusley doe constitute ordaine and make my wellbeloved kinsman
Richard Willcoxon of Whenerham in the Countie of Chester gent my sole
executor to execute and perform this my last will and testament and like-
wise to execute and perform what is wanting by me in the execution
of the said last will and testament of my said father Richard Cusley giving
and
allowing unto my said executor and his assigns or to his executors or administrators
full power to receive and take out of my estate aforesaid all such cost damages
and expenses as he or they shall from time to time bee occasioned to expend
disburse
and be rammified in the pursuance and execution of this my last will and
testament of my father and likewise allowinge to my said executor all such
cost
and damages as he shall lay out and sustaine in the pursuance of my affaires
and
business during my life to be likewise taken by satisifyed unto him out of
my
estate aforesaid In witnes whereof I the said Mary Cusley have hereunto sett
